RIHA - Emine Şenyaşar, whose husband and two sons were murdered by the relatives and guards of former AKP MP İbrahim Halil Yıldız, was fined in the case where she was tried on the allegation of "insulting" Yıldız.
The third hearing of the case filed against Emine Şenyaşar, whose husband and two sons were murdered by the bodyguards and relatives of former AKP MP İbrahim Halil Yıldız on June 14, 2018, in Pirsûs (Suruç) district of Riha, was held on the grounds that she "insulted" Yıldız.
While Şenyaşar did not attend the hearing held at the Urfa 3rd Criminal Court of First Instance, his lawyer was present.
At the hearing, which started with identification, the prosecution repeated the opinion it gave at the previous hearing and demanded that Şenyaşar be punished.
Ali Arslan, the lawyer of Şenyaşar, who gave the floor against the opinion, said: “The trial in question is being carried out based on the report kept by the law enforcement. At the previous hearing, we requested that a report be obtained from an impartial expert, without relying on the biased expert report held by the law enforcement. Due to the possibility of the application of Article 129 of the TCK, a request was made to summon the file in which the client's wife and children were murdered and which is currently ongoing in Malatya; however, our demands were not fulfilled. Imposing such a sentence would violate the client's right to a fair trial."
Stating that his client denied the accusation against him, lawyer Arslan said: "Even if it is accepted that the words my client allegedly said were spoken about the complainant, they should be considered as the painful words of a mother whose husband and two children were murdered; moreover, the words considered 'insult' should be evaluated within the scope of freedom of expression."
For this reason, lawyer Arslan requested that his client be acquitted first, and if the court is of the opposite opinion, it be decided that there is no need to impose a penalty, considering that the insult was committed against an unjust act.
A FINE WAS GIVEN
The judge, who took a break from the hearing to announce the decision, decided to impose a fine of 1,700 TL on Emine Şenyaşar and postponed the announcement of the verdict.
10 CASES WERE FILED AGAINST ŞENYAŞAR
Since March 9, 2021, when Emine Şenyaşar started keeping a Justice Sit-in for her murdered husband and children, 31 investigations have been launched on similar charges, 10 of which have turned into a lawsuit.
