DİYARBAKIR - MLSA Legal Unit applied to the Constitutional Court on behalf of the arrested MA Editor Sedat Yılmaz.

 

Media and Legal Studies Association (MLSA) Legal Unit applied to the Constitutional Court (AYM) on behalf of the editor of the Mesopotamia Agency (MA), Sedat Yılmaz, who was detained in Diyarbakır in April as part of the investigation launched by the Ankara Chief Public Prosecutor's Office and was arrested on May 3 on charges of "being a member of a terrorist organization".

 

In the application, it was stated that it was a freedom of expression case that directly concerns journalism, and it was requested to be examined immediately and with priority. In the application, which states that the "torture and ill-treatment" prohibition imposed by the Constitution and the European Convention on Human Rights (ECtHR) was violated during Yılmaz's detention, the attack that Yılmaz was subjected to when he was handed over to Ankara from Diyarbakır was included.

 

VIOLATION OF THE RIGHT TO FREEDOM AND SECURITY

 

It was also stated in the application that the journalist's "right to private and family life" and "freedom of expression" were violated during the detention and arrest procedures. In the application, it was also emphasized that the “right to freedom and security”, which is also guaranteed by the Constitution and the ECtHR, was violated because the detention was not justified and was carried out arbitrarily.

 

ATTENTION TO ECtHR 18

 

It was drawn attention that the reasons for the arrest were related to Yılmaz's journalistic activities, and it was also stated that the detention and arrest procedures constituted a violation of "freedom of expression". It was also noted that the arrest was made with political motives, that he was a Kurdish and opposition journalist, and that it took place before the Presidential election in Turkey, in violation of Article 18 of the ECtHR.
